Internet sales tax challenge could face Supreme Court
Read this NLC article to learn how a lost internet sales tax challenge before the South Dakota Supreme Court could send the law in question to the U.S. Supreme Court as early as 2018. In 1992, before internet sales proliferated, the Supreme Court held in Quill Corp. v. North Dakota that states cannot require retailers with no physical in-state presence to collect sales tax. State and local governments are keeping a close eye on this issue as several Justices have indicated their willingness to hear the case. More
