Restricting the use of Transportation Benefit District (TBD) vehicle fees

Sen. Benton (R-Camas) has introduced SB 5093, restricting the expenditure of TBD vehicle fees to “highway purposes” which includes the construction, maintenance, and operations of public roads, bridges, and city streets. Case law has generally construed highway purposes to exclude public transportation and other purposes not directly benefiting highway users. As such, the bill would place significant new restrictions on the use of TBD vehicle fees. The bill would only apply to fees imposed after January 1, 2013.

The bill is currently scheduled for public hearing in the Senate Transportation Committee at 3:30pm on January 30. AWC opposes this restriction on local authority, and we expect other interests will testify in opposition as well.
