1094 & 1095 reporting

The Affordable Care Act requires that certain employers and all health insurance companies report information to covered employees, and to the IRS on an annual basis.

IRC Section 6055 requires insurers, plans sponsors or multiple employer plans to report enrollment in minimum essential health coverage to the IRS and to the insured employee. This is accomplished through the following IRS forms:

  • Transmission by insurer, multiple employer or plan sponsor:
    • Form 1094-B (to IRS), deadline – February 28; or March 31 if filing electronically
    • Form 1095-B (to employee), deadline – March 2

The purpose is to report information to the IRS and taxpayers about individuals who are covered by minimum essential coverage and therefore are not liable for the individual shared responsibility payment. The Trust will send a 1095-B to each Trust covered employee, and will report to the IRS on 1094-B. While Trust member employers are not expected to complete these returns, if you have employees covered outside of the Trust you will want to work with that insurer/plan sponsor to confirm compliance.

IRC Section 6056 requires an applicable large employer (50 or more FTE equivalents) to report to the IRS and the employee the offering of minimum essential coverage that is affordable and provides minimum value. This is accomplished through the following IRS forms:

  • Transmission by employer:
    • Form 1094-C (to IRS), deadline – February 28; or March 31 if filing electronically (any employer filing more than 250 forms must file electronically)
    • Form 1095-C (to employee), deadline – March 2

This reporting is required for applicable large employers only – those with 50 or more full-time/full time equivalent employees. The purpose is to report the offer of health coverage, the employee share of the lowest cost monthly premium, and subsequent enrollment.
