Exchange Notice Compliance

Prior to October 1,2013, the Affordable Care Act (ACA) mandates all employers notify employees of the State Health Care Exchange. As a service to our medical-insured employers, the AWC Trust is issuing the Exchange Notice for you. The AWC Trust mailed the Exchange Notice to employees’ homes in late September 2013. The legal authorization for the Trust to notify member employers was confirmed on September 4, 2013 by U.S. Department of Labor (DOL) in FAQ Part XVI.

Your action is still needed!

For those employees not insured through the Trust medical plan (i.e., receive a W-2, insured through Kaiser, etc.), you are required to send a notice to these individuals prior to October 1, 2013. Additionally, all new hires are required to receive a notice within 14 days of hire. For both these instances, we have provided you with an appropriate template for modification to suit your needs.

Changes to COBRA Notice

Employees and dependents who become eligible for COBRA will also have the option to purchase coverage through the Exchange and potentially receive a premium subsidy. The Trust’s COBRA Administrator, Northwest Administrators (NWA) has revised the COBRA election form to reflect the addition of the Exchange. The Trust’s COBRA Notice to Administrator forms remain unchanged.
