Public records updates

A few public records bills remain alive in the Legislature. These include:

  • HB 1431/SB 5395 modify exemptions relating to real estate appraisals. HB 1431 is in Senate Rules. SB 5395 is also alive and in the House Rules Committee.
  • HB 1554/SB 5396 exempt information of guardians or family members of children enrolled in certain programs, including parks and recreation programs. HB 1554 is in Senate Rules, and SB 5396 is in House Rules.
  • HB 1189 concerns hours of availability for inspection and copying public records. It passed the House and is in Senate Rules.

In addition to individual bills, AWC was successful in incorporating proviso language into the House budget proposal, HB 1106, regarding a study on assessing what it costs local governments to transmit electronic data under a public records request. The proviso asks the State Auditor to develop an actual cost estimate over the 2015 interim that could be used by agencies for paper and electronic copies. The Auditor would be expected to issue his findings in a report to the Legislature no later than December 2015.
