Restricting the use of eminent domain

The Senate Law & Justice Committee is scheduled to hold a public hearing on SB 5014 at 1:30pm on January 23. The bill, sponsored by Sen. Benton (R-Vancouver) declares that “government's use of eminent domain in Washington should be restricted to uses that protect public health and safety or provide public use facilities… .” Further, the bill states that “No government shall take or damage private land or any interest in real property that is not to be used for the construction of a public use facility or the provision of a public service necessary to protect public health and safety.”

We are concerned about the implications of this bill and we will be seeking feedback from city attorneys and others. You can send your comments to Dave Catterson.
