Judge Says City Can Ban Recreational Marijuana Business

Last week, a Pierce County Superior Court Judge upheld the City of Fife’s ability to ban I-502 businesses. This case originated from a challenge to the City’s ban by a prospective recreational marijuana retailer trying to operate in Fife. This decision will likely be appealed, and some interests may ask the legislature to outlaw such bans. The Washington State Attorney General agrees that cities have the power to ban these businesses under general police powers. AWC continues to advocate for local control so each jurisdiction can decide what is appropriate for their unique circumstances.
