Legislature looking at a wide variety of personnel legislation

Here is a brief summary of some pending legislation pertaining to personnel:

  • SB 5112 – Would provide Workers Compensation Retrospective Rating Programs the ability to assist in scheduling independent medical exams (IME) and vocational rehab appointments.
  • SB 5128 – Repeals existing structured settlement program and creates a new one. Parties to an allowed claim must submit settlement agreements to BIIA. Light-duty work would no longer need approval from health care provider.
  • SB 6183 – Would require public employee collective bargaining sessions to be open meetings. Scheduled January 30 at 10am in the Senate Governmental Operations Committee.
  • SB 6223 – Modifies industrial injury and occupational disease law. Compensation would occur only when work-related activity is shown to be a substantial contributing cause to the injury or disease.
  • SB 6179 – Any group of employers who are substantially similar may adopt a plan for self-insurance to address compensation claims. This bill was heard on January 22. AWC signed in support.
  • HB 2230 – Requires employers to reimburse employees for all necessary business expenses including cell phones, phone chargers and other equipment. Scheduled for January 28 at 1:30pm in the House Labor & Workforce Development Committee. AWC plans to sign in opposed.
  • HB 2238 – Requires accrual of paid vacation leave for employees who work an average of 20 hours per week. This bill was heard on January 24. AWC signed in opposed.
  • HB 2295 – Limits industrial insurance benefits for injuries or diseases caused by drugs or alcohol use. This bill is scheduled for the House Labor & Workforce Development Committee, January 31 at 1:30pm.
  • HB 2332 – Increases penalty for wage violations from double damages to triple damages. This bill was heard on January 22. AWC signed in opposed.
  • HB 2333 – Creates parallel retaliation provisions in several wage related sections including the Minimum Wage Act, the Industrial Welfare Act, prevailing wage provisions and wage deduction. This bill was heard on January 22. AWC signed in opposed.
