Attorney General Opinion affirms local control

Attorney General Ferguson’s office released an opinion today stating that local governments are not preempted by state law from prohibiting the location of marijuana related businesses within their jurisdiction. Last fall Chair Foster of the Liquor Control Board (LCB) requested the opinion hoping to clarify local governments’ authority in controlling the location of marijuana producers, processors and retailers. AWC's view is that this affirms local control, but there are still many discussions to be had at the state legislature this year. AWC will continue to keep you informed.
