Bill to end pension spiking advances out of Senate Ways & Means

SB 5916, introduced in response to reports of LEOFF pension spiking cases, was heard in the Senate Ways & Means Committee last week. This week, the bill was amended and voted out of committee.

The bill was amended as follows:

  • Collective bargaining agreements are prohibited from having provisions that assign overtime based on seniority.
  • The changes to excess contributions are made retroactive to June 30, 2011.
  • The Department of Retirement Systems is directed to conduct audits where the base salary reported for a LEOFF Plan 1 member increased by more than 10% in the final two years prior to retirement.

It is unclear whether the bill will be considered during the likely upcoming special session. AWC has been supportive of the concepts included in the bill.
