Problems with securing signatures for final plats?

Sen. Kline has asked AWC to weigh in on whether we are facing difficulties with the requirements in RCW 58.17.165. Constituents of Sen. Kline have raised concerns about the provisions of this statute which require the signature of all of a property’s owners in order to record a final subdivision when any of the land is dedicated to a city or county (for roads, parks, etc.).

Some developers are expressing concerns that, because foreclosures and bankruptcies can make a determination of clear ownership difficult, some jurisdictions are hesitant to approve final plats because they are not confident that the appropriate signatures have been gathered.
