Bill would limit cities’ authority to ban marijuana businesses

Back again in 2016, HB 1438, sponsored by Rep. David Sawyer (D-Lakewood), would limit cities’ ability to prohibit the production, processing and sale of marijuana in their communities by requiring any such prohibition only by public vote. Currently cities have the authority to place bans or moratoriums on such activities through ordinances.

HB 1438 is scheduled for public hearing in the House Commerce & Gaming Committee on Tuesday, January 12 at 1:30 pm. AWC staff plans to testify in opposition to any new limitation on existing local authority.
