Timing of penalties for GMA non-compliance

Pierce County is advocating for HB 1401 with the goal of clarifying when state agencies can penalize local jurisdictions found to be out of compliance with the Growth Management Act by the Growth Management Hearings Board (GMHB) or the courts. Specifically the bill would clarify that local governments cannot be penalized during a period of remand (a period during which the local government is actively working to remedy a noncompliance issue as ordered by the GMHB), or during the pendency of an appeal to the GMHB or the courts. In addition jurisdictions would be eligible for grants or loans if they were in compliance at the time of award rather than the time of application.
